MEMBERSHIP AGREEMENT

Customers who use and shop on this e-commerce website shall be deemed to have accepted the following terms:

1. PARTIES

1.1. This Membership Agreement (“Agreement”) is concluded between 3H TEKSTİL ÜRÜNLERİ SANAYİ TİCARET LİMİTED ŞİRKETİ (“Company”), the owner of the website www.micca.com.tr (“Website”), located at Merkez Mh. Yunus Emre Cd. No: 2 Çekmeköy / Istanbul – Turkey, and the website user who becomes a member by accepting the terms herein (“User”), for the purpose of determining the conditions under which the User benefits from the services offered by the Company.

1.2. All web pages on the Website and all pages linked thereto are the property of and operated by the Company. By using the services offered on the Website, the User acknowledges and agrees that they are legally competent, over the age of 18, authorized to enter into contracts under applicable laws, have read and understood this Agreement, and agree to be bound by its terms. The User is solely responsible for any damages arising from providing inaccurate or outdated information.

1.3. This Agreement imposes rights and obligations on the Parties, and by accepting it, the Parties declare that they will fulfill such rights and obligations fully, accurately, and in a timely manner.

2. RIGHTS AND OBLIGATIONS OF THE PARTIES

2.1. The Company reserves the right to make changes to prices and offered products and services at any time.

2.3. The Company undertakes to ensure that the User benefits from the services subject to this Agreement, except in cases of technical malfunctions.

2.4. The User agrees not to produce, share, or transmit content that is unlawful, immoral, misleading, offensive, obscene, pornographic, infringes intellectual property rights or personal rights, or encourages illegal activities. The User shall be solely responsible for any damages arising therefrom. The Company reserves the right to suspend or terminate accounts and initiate legal proceedings if necessary.

2.5. To obtain membership status, the applicant must approve this Agreement, provide accurate and up-to-date information, and have their application approved by the Company. Membership is available only to individuals over 18 years of age. The User may terminate their membership at any time by sending an email to [email protected].

2.6. In the event of a dispute regarding account ownership, the Company shall consider the last person who made a payment using the relevant membership account as the rightful account holder.

2.7. The Company may share User information with authorized authorities when required by applicable legislation.

2.8. The User is solely responsible for the confidentiality and security of their username and password.

2.9. The User shall not use the Website in an unlawful or unethical manner, including but not limited to the prohibited actions listed herein.

3. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights on the Website belong to the Company or relevant rights holders and are protected by national and international laws.

4. CONFIDENTIALITY

The Company shall not disclose Users’ personal data to third parties except as required by law.

5. DISCLAIMER OF WARRANTIES

Services are provided “as is” and “as available” without any warranties, to the maximum extent permitted by law.

6. REGISTRATION AND SECURITY

Neither Party shall be liable for failure to perform obligations due to force majeure events.

This Agreement enters into force upon electronic approval by the User.
